The Death Penalty and the Shared Legacy of Race This chapter raises profound questions about the political values Americans share in post–Civil Rights America. The declining belief in the possibility of racial progress coupled with the view and experience of the state as unjust reaffirms African Americans’ out-group status. Democracy is undergirded by political norms that include concerns of race. For some African Americans residing in Texas there is a continuous thread between the death penalty of the past and the death penalty of today. This perception is driven in part by their knowledge of the administration of the death penalty, but to a greater degree by the idea that the policy is useful to politicians and a holdover from past injustices that have yet to be completely remedied. This research shows that the effects of the increasing involvement of African Americans with the criminal justice system are not contained to those convicted of crimes.
