Announcements

The Spring 2024 April/May exam schedule  is now available.

Practice exams are for familiarizing yourself with Exam4, not for practicing answers. You will not be able to open a completed exam.

Exam Requirements

Use the Newest Exam4 Software.

For the January exam period you must use Exam4  Release 23.2 for Mac or Release 23.2 for Windows , both of which  expire March 29, 2024 .

The installer for March 7-Week exams will be available at midnight on February 29, 2024.

Take a Practice Exam . Each semester, examining students are required to complete a Practice Exam that serves as a pretest verification to ensure that their equipment is compatible with Exam4 hardware and operating system requirements. Failure to complete the Practice Exam will result in the following consequences:

  • Low priority for technical support during an exam with no time-recovery for computer malfunctions.
  • No external devices permitted during exams (with the exception of a keyboard, mouse, and single monitor on a desktop computer used during an unproctored exam).

Exam Information You'll Need for Exam4

Before you take an exam, you should be sure to collect a few key pieces of your information from ExamReporter and the Exam Schedule.

General Exam Preparation Guide

HOW DO I PREPARE FOR AN EXAM?

General Tips for Exam Preparation:

  • Preparing for the Exam
  • Refer to the EXAM SUBJECT MATTER AND PRACTICE EXAMS section on exam-specific study guides and practice exams.

Exam subject matter (test content), sample questions & practice exams by title series

The sample test questions are provided to familiarize applicants with the format and type of questions that may be on the exam. They are for illustrative purposes only and may not represent the actual difficulty level of the questions on the exam. The NYS Courts do not release exam questions. Test-takers are prohibited from taking test materials and copying tests questions from examinations.

Test Security Protocols

Court Security Series

Court clerk series (court assistant, court clerk and surrogate's court clerk), court interpreter series, court reporter series, office clerical series & court revenue assistant, law librarian, law library support, exam development.

1. WHAT IS THE EXAM FORMAT?

In general, exams questions are presented in a multiple-choice format.  Some exams may include an oral component which assesses communication, presentation, and/or organizational skills whereas other exams simulate job-related activities that may be encountered on the job and assess proficiency in a specific skill. Refer to the title-specific exam guides for detailed information about the format of each exam.

Multiple-Choice Exams: These exams consist of questions in a multiple-choice format in the form of a question or incomplete statement and four possible answer choices. Candidates are required to select the answer-choice that best answers the question or completes the statement. It is to the candidate’s advantage to answer every question, even if the candidate is not sure which answer is correct. Points are not deducted for guessing.

Oral Exams:  Oral exams are used to assess communication, problem solving, interpersonal, and organizational skills usually in a structured interview-type format.  Candidates are typically presented with a situation they may encounter on the job and are required to respond to the given situation.

Simulation Exams:  This format is generally used for titles in the Court Reporter and Court Interpreter series.  In these types of exams, candidates are presented with a video simulation of a courtroom situation and are required to demonstrate their skill in court recording or court interpreting.

2. HOW ARE EXAMS DEVELOPED?

Exams are developed based on job analysis information and input from Subject Matter Experts (SMEs).  SMEs are individuals who have been in the positions being assessed or are managers supervising individuals in those positions/titles.

Job Analysis : A comprehensive job analysis is conducted for each exam prior to its administration.  The purpose of a job analysis is to gather information about the tasks performed by individuals doing the job and the skills needed to perform those tasks in a satisfactory manner. This is accomplished by conducting onsite visits, meeting with and interviewing incumbents and their supervisors, observing incumbents perform their jobs, if feasible, and conducting surveys.  The contents of an exam are guided by the results of the job analysis which acts as a blueprint, to ensure that the exam is job-related. A comprehensive job analysis is conducted for each title.

Subject Matter Experts (SMEs) : An examination committee, comprised of members called subject matter experts (SMEs), thoroughly familiar with the job and the knowledge, skills and abilities (KSAs) needed to perform the job are instrumental in developing the exam questions and exam content.  Based on the job analysis results and the SME's knowledge, committee members develop the examination.  Committee members are provided with question-writer training and questions are reviewed by the committee and a group of testing experts.

Exam Scoring and Grading

1. HOW ARE PASS SCORES SET?

In general, for written multiple-choice exams, final scores are converted from raw scores (number of questions answered correctly) and placed on a scale that ranges from 0 to 100. The passing raw score (number of questions answered correctly) is determined after an exam is given and all the test results have been analyzed. A test taker must receive a scaled score of 70 in order to pass an examination.

A scaled score of 70 may or may not be equivalent to 70% of the questions answered correctly on any exam. For example, if an exam contains 100 questions and it’s determined that a test taker needs to have gotten at least 65 questions correct in order to pass the exam, then 65 (the raw score), is converted to a scaled score of 70, and the test taker will receive a 70 on the exam.

The passing score is also in part determined by Rules of the of Chief Judge, §25.13:

The Chief Administrator of the Courts may authorize the use of any professionally recognized examination scoring and conversion methods, taking into consideration the type of examination, the examination difficulty, the size of the applicant population in relation to the number of positions to be filled, labor market conditions, or other factors which can affect the number of eligibles.

2. WHAT HAPPENS AFTER AN EXAM IS ADMINISTERED?

After an exam is administered, a statistical analysis is conducted to review candidate responses to each test question.  The results of the exam are analyzed to determine if there are any group (e.g., gender, race/ethnicity) differences in test question responses.

After this process is completed, a passing cut score is set with consideration given to such factors as the difficulty level of the exam, historic pass rates, the staffing needs of the courts, and past hiring patterns as well as the Rules of the Chief Judge.

Welcome to the New York Law Course

Please carefully read the following instructions in their entirety before proceeding to the NYLC.

The New York Law Course (NYLC) is an online, on demand course on important and unique principles of New York law in the following subjects: Administrative Law, Business Relationships, Civil Practice and Procedure, Conflict of Laws, Contracts, Criminal Law and Procedure, Evidence, Matrimonial and Family Law, Professional Responsibility, Real Property, Torts and Tort Damages, and Trusts, Wills and Estates. Completion of the NYLC is required in order to obtain a license to practice law in the State of New York.

The NYLC consists of approximately 17 hours of video lectures with embedded questions that must be answered correctly before you may continue viewing the lecture. Once an embedded question is correctly answered for a particular segment, that segment cannot be re-watched. You must view each lecture in its entirety and at its normal speed. Your time viewing each video segment will be audited by the Board. Advancing or speeding up the video by any means is strictly prohibited. Failure to view each segment of each lecture in its entirety and at its normal speed may result in the institution of misconduct charges under Board Rule 6000.13. Penalties may include requiring you to repeat the NYLC in its entirety, nullification of your registration for the NYLE, nullification of your NYLE score, a period of suspension from repeating the NYLC and/or NYLE, and disclosure of your misconduct to the Appellate Division in New York having jurisdiction over your application for admission and to other jurisdictions. If a user experiences technical problems while watching the videos it is incumbent on the user to contact the Board office immediately to report any issue and seek assistance. Please note that the NYLC was not designed to be viewed on a cell phone. Users who have advanced videos or who have failed to watch videos in their entirety, including users who used the scroll bar on any device including a phone, have been caught in the Board's electronic audits and have been the subject of misconduct charges that have resulted in the above mentioned penalties. It is important that you understand the benefits of the New York Law Course (NYLC). It is therefore highly recommended that you give yourself several weeks to watch the NYLC at a relaxing pace to fully absorb all of the material. If, however, you opt to start the NYLC within 72 hours of any given deadline and then experience problems related to any technical issue, including high volume concurrency, the deadline will NOT be extended. As a reminder, your viewing of the NYLC is audited. Keep in mind that completing the NYLC does not automatically register you for the NYLE. Registration is a separate step that must be done through the Applicant Services Portal.

The videos and embedded questions are copyrighted. It is a violation of Board Rule 6000.13 to copy or give to other applicants or third parties any of the embedded questions or answers or to make use of any such materials that may have been shared with you by others. Violation of Board Rule 6000.13 may result in penalties as described above, as well as such penalties for copyright infringement as may be appropriate.

You may complete the NYLC up to one year before or any time after the date on which you first sit for the UBE, subject to the application filing deadline of Section 520.12(d) of the Rules of the Court of Appeals. That section requires that a complete application for admission to practice in New York be filed within three years from the date when you sit for the second day of the UBE, whether taken in New York or in another jurisdiction. If you complete the NYLC more than one year before sitting for the UBE, you will be required to repeat the NYLC in its entirety.

You must complete the course in its entirety before you may register for the New York Law Examination (NYLE). Passing the NYLE is also a prerequisite to admission to practice in New York. For more information about the NYLE, visit the Board of Law Examiners homepage at www.nybarexam.org .

Before you commence the NYLC, we urge you to download and print the Course Materials. These materials will assist your understanding of the subject matter as you view the lectures. Electronically searching the Course Materials while taking the NYLE by using a searchable version of the Course Materials is a violation of Board Rule 6000.13 and may result in penalties including nullification of your registration for the NYLE, nullification of your NYLE score, a period of suspension from repeating the NYLE, and disclosure of your misconduct to the Appellate Division in New York having jurisdiction over your application for admission and to other jurisdictions.

The first video you will view is a welcome message by the Hon. Jenny Rivera, Associate Judge of the New York Court of Appeals. After viewing Judge Rivera’s message, you will be directed to a menu of the subject matter lectures which you may view in any order.

Select a lecture from the menu by clicking on the View Video Course button next to the subject.

If you wish to enable Closed Captioning or Subtitles, you click the box for Enable Subtitles before you select View Video Course.

After each segment of a lecture is completed, you will be prompted to answer a multiple choice question based on the material presented. If you answer the question correctly, the video will proceed to the next segment of the lecture after a brief pause. At this point, you cannot re-watch that segment. If you answer the question incorrectly, you will be returned to the point in the lecture where the presenter discusses the subject of the question, and you will be required to re-watch that segment until the question is displayed again and you have answered it correctly. At no point can you fast-forward the segment, even if you must re-watch part of the segment because you answered a question incorrectly.

All of the videos close with a final question that must be answered correctly in order to receive credit for watching that segment and having that Video Course marked as “Completed”. As the Video Course concludes do not close or exit the video until the final question appears and is answered correctly, otherwise you will be required to watch that segment again. Once you have completed a Video Course, you may not access that video again until the entire NYLC has been completed. At this time, you may re-watch any Video Course without the need to answer embedded questions.

After a question is successfully answered for a particular video segment, you may continue viewing that lecture or exit and resume the video at a later time. If you exit a video segment before you correctly answer the embedded question, your time in that segment will not be saved and you will have to re-start it.

Please be aware that closing the window or using the back button in your browser will not save your current place in the video and you will not receive credit for viewing all segments of that video. Therefore, we recommend that you do not use the internet browser back and forward buttons or refresh your page at any time during your NYLC session and that you watch each segment to completion, which includes correctly answering the embedded question. Attempting to watch more than one Video Course at the same time is strictly-prohibited and will result in an interruption of the NYLC. Also, if any segment runs idle for longer than 15 minutes, you will automatically be logged out and will not get credit for that segment.

After you have successfully viewed all segments of a Video Course (which includes correctly answering each embedded question), the menu in your account will indicate that you have completed that Video Course and you may select another subject from the menu to view.

You may view the lectures in any order you choose, but you may not register for the NYLE until you have timely and successfully completed all of the lectures. The dates and deadlines for the NYLE are located on the Board's website.

After you have successfully completed all videos encompassing the NYLC, you will have access to the lectures through your BOLE account without answering the embedded questions. This future access is not an excuse or defense to speed up and/or fail to watch any given video during the course of your initial required viewing of the NYLC.

In order to begin by viewing the welcome video, proceed to the Login tab at the top of the screen.
