What are the main differences between spoken and written communication?

Spoken and written communications are two different aspects of communication and come with their own varied differences. Written communication is stronger as compared to the spoken words because it is only when the words are written down so they get the meaning and confirmation to be true. However, in the scenario of informal language, it is often the spoken communication that gets the advantage over the written one!

To what extent do you think the media influences how people communicate with each other?

Media definitely has a major impact on the way people communicate with each. With the new age sources for communication, like twitter, youtube, facebook coming over in the scenario, people often express their opinions quite frankly. Even more, most people tend to use media for better communication while others have even created facades for communication.

Do you think there are differences in the way men and women communicate?

Men and women are two different species and so do have different ways of communicating. Their thought process is different and their way of communicating henceforth is unique. Although I am not in a favor of grouping the two, most men are likely to be a bit louder, use more humor and while communicating tend to use more flamboyant words. On the other hand, women are slightly gentler when talking. They tend to be more respectful of the other person and use gestures while interacting.

Do you think that people become better communicators as they get older?

Communication is something I believe comes with time. Some people tend to become better as they grow old, but I think it is more of a matter of experience rather than just age. For instance, someone who has always lived a bit aloof with most people might not be good at communicating with people when compared with someone who has been very indulgent with people around.

Do you agree that education has a strong and positive effect on people’s ability to communicate effectively?

Education does not teach much about communication when only going to school or colleges is considered. This is something that most of the generation gets to do. What matters is how the students have utilized the education system. Some of the students get bullied in schools and colleges and this does impact the way of their communication in later life.

What impact has the growth of technology had on the way people communicate and how do you think this will develop in the future?

Technology has seriously impacted the way people communicate more than anything else. The change from communicating over a letter to the smartphones has been dramatic. With technologies advancing, things are definitely going to get better or for that matter different. There is a possibility of being able to interact with people in virtual environments as well.

No Matter the Speaking Interview Set-up, imagine yourself having a team meeting with a colleague at your company, your are being confident, professional and well-spoken. *You are not both from the same department, you are from different departments, like IT and marketing, so you need to COMPLETELY and CLEARLY express yourself, giving examples when needed.

May I see your identification please?

Yes, certainly, here is my id that I used a couple of weeks back when I registered for the test online. 

What is your full name?

My full name is Timothy Fredrick Anderson, please just call me Tim for short, it’s what I’m used to hearing. 

Where do you live? – high band communication is such that it is detailed, logical and visible/quantifiable

I have been living in a two-bedroom flat in the heart of Budapest for the past couple of years with my lovely wife and daughter, as most people know this city is the capital of Hungary. 

***In the beginning, avoid contractions, then later use them. 

So, in the beginning, “I have been living…” —-later—-“I’ve been living”

This makes your grammar use very clear for the examiner and it will emphasize and slow your language at the start. 

What do you like about living there?

I love the 12 foot ceilings in my flat, it really makes it bright and spacious, also I love my balcony which overlook a city park and on nice summer days, I can go out there for a barbecue or to catch some sun rays. 

Let’s talk about communication.

What technology do you use to communicate to others? ***To get good scores on IELTS – lead with the answer not the explanation – answer – explain and example,

Most of the time I use my Samsung S8 and my HP laptop to communicate with friends and family either through Skype or Whatsapp, since these software are both efficient and cheap. In fact, I just got off a 30 minute English practice call on Skype with one of my friends in Japan just before walking into this exam. 

Which is your favorite way to communicate? Why?

Well, even though I’m forced to communicate often through the technology I just mentioned, because of the current pandemic situation, I actually prefer to have conversations in-person, face-to-face because I find that I get a lot more emotional information in this way and it is extremely valuable for personal relationships. I mean I couldn’t imagine how tough it would be if I could only communicate through a screen with my daughter for longer periods of time. 

How often do you send text messages? When you hear “how often” -> put a number to it!

I definitely send quite a few messages throughout the day, I would say easily 30 to 50 in a 24-hour period, whether contacting friends, family or coworkers, I’m typing away with my thumbs regularly on my mobile.

• Old Technology : In past era, people communicate with each other via telephone and letters. Even before it, they use to interact face to face only.
• New/Modern Technology : In modern era, people communicate with each other using Internet (Digital Era).

Role of technology: Technology has changed the way we communicate with each other, even the way we represent ourselves in the society. With time people are becoming more extrovert with the help of technology as they can easily express their views on social media like Facebook, YouTube, WhatsApp and many more.

Family and Communication:

Negative impact of New/Modern Technology on family:

• Modern Technology has changed the basic structure of our family. Family members talk less with each other.
• Spend more time on social media and people live in a virtual world
• Thus, they have not enough time to spend with their family

Positive points of Old Technology: – Family members used to communicate with each other from one city to another through telephone and letters. Old Technology did not interface with the relations of the individuals that much as compared to the modern technology, rather it solidified them.

Face to face v/s long distance communication:

Problems of Long-Distance Communication:

Role of Technology: Technology has changed face-to-face communication and has transformed it into virtual communication. Ultimately, came up with long term distances.

Types of communication:

• ‘One to one’ communication via mobile phones and messenger.
• ‘One to society’ communication is done through social media, when some influencer gets live and shares his thoughts.

Role of Technology: Technology has transformed Communication. It has been changing from ‘one to one’ communication into ‘one to society’ communication.

The Development of Character and Personality :

Communication helps to improve our personality. Because when we can share feelings and emotions with others, we learn new things. As technology has changed the way of communication, it helps an individual to become more extroverts in nature, bold and mature.

Innate Personality VS Developed Personality:

Innate: Innate means inborn talent.

Developed Personality: Developed personality is made through learning and gaining knowledge about various aspects of life from the society.

Role of Communication and Technology: Communication provides help to express inborn talent (especially modern or new technology). It also helps to develop skills and gain knowledge because through communication. With it we get to know about various new things. ‘ Communication helps to educate ourselves’.

Personality:

• Happiness is hard to define as it means different things to different people.
• People feel happy when share their views and thoughts and spend time with family.
• Another source of fun and enjoyment are hobbies, sports and games.
• Moreover, money is also considered as a source of happiness but it is not.
• There are others which define happiness as something deeper and are into salvation.
• To live a good life, its important to be happy and have stability.
• Life has to be meaningful to remain happy.
• Achievement and Success lead to happiness.
• Rearing and bringing up children also leads to happiness.
• Religious activities can also cause happiness.
• Same like happiness, success is hard to define.
• Raising a family is considered as symbol of success by few .
• Being wealthy or having a high status are elements of success in modern life.
• Rich and famous people as seen as successful in life but the masses.
• Bill Gates, Steve Jobs are epitome of success for the people.
• Their success is due to their hard work in their profession.
• Achieving personal or professional goals is also symbol of success.

Nature or Nurture:

• Genetics/ genes determine our personalities
• Our abilities and talents are inherited from our parents.
• While Others believe that our education and upbringing are more crucial.
• Our personalities develop according to the influences around us.
• Nurture is more important than nature.
• Our personality is more influenced by the way of nurturing.
• Personalities are the hard work of nature and nurture.
• By working hard and planning, we can achieve our goal.
• Many successful people are self-made as they work hard
• We are not limited by our genetic characteristic or upbringing rather they develop with time.

Communication: Practice Exercise

This is a common topic for IELTS speaking part 3. How good is your vocabulary for the topic of body language which is one part of communication?

Fill the gaps of these sentences with the suitable words:

1. I had no idea what she was talking about. Then suddenly she asked a question that I couldn’t understand so I just ………….. my shoulders and walked away.

Hi Liz, I have a very critical question.I heard from one of the ILTS instructors in writing task 1. it’s not necessary to write a conclusion…what u think?

There is no conclusion in writing task 1. The examiner is looking for an overview in task 1 and a conclusion in task 2. This is not an opinion, it is a fact which IELTS has shown in the band scores. All the best Liz

A good try. If a person knitted their eye brows, it means they were concentrating really hard or possibly a bit angry. So, for this sentence it wouldn’t work. The key is “a tall story” which means a story that might be imaginary because it is too unbelievable. Think of what people do with their eye brows if they don’t really believe something. Check your answer tomorrow. Liz

Hi Liz, My name is Raj and I’m from India. on August 13 , I given a IELTS exam. I wrote in task 2 as per that requirements and your bolg aid me to do so . task 2— “some people say that government should not spend a money as they have disadvantage people like unemployed and homeless, to what extent do you agree or disagree. make the comparison where relevant”.

I used following structure

Introduction paragraph –background statement(today…..) –detailed background statement (this has been seen in……) —- thesis(…….disagree…this idea is supported) —- outline(2 point of view)

supporting paragraph 1 topic—-(Firstly) example(Take,India,for example..) discussion (it is cleared….) conclusion (.it is believed….)

supporting paragraph 2 —topic(on the other hand….) —example(For instance……in Nagaland.) —discussion(it is obvious….) —-conclusion (thus…..)

conclusion paragraph –summary (2 POV) —restatement of thesis —recommendations (it is recommended..)

Can you say this structure is going to help me for score better. I also used the words and phrases Like precursor, fortify,account,the world over,accomplish…. etc.

I can’t say without seeing the actual ideas and how you presented them in each paragraph. Body paragraphs do not need conclusions. “It is believed” is about what other people think but this essay is only about what you think, not other people. Using such words as “precursor” and “the world over” will not help you get a high score unless all your vocabulary is accurate and strong. Just a few words won’t make much difference. The introduction only needs two statements, not three. Without seeing your essay, I can’t comment further but wish you good luck with your results. All the best Liz

1. Do you prefer chatting face to face or texting? 

Well it really depends, if you’re talking abou t hanging out with friends that I haven’t seen for ages, or if it’s an important occasions where a lot of people get together to celebrate a very important event in our lives, then I would definitely love to engage in a conversation with people around me. However, there are lots of occasions when chatting face to face is impossible. For example, most of my best friends are not living in Taiwan, so I can only text them. Sometimes if you have business partners overseas, you can only use conference calls or text messages to contact with vendors outside of Taiwan, so it depends on the situation.

• Collocation / Phrasal Verb:  to hang out with friends – spend time, enjoy time, relax with friends
• Collocation:  engage in a conversation – start and maintain a conversation with someone

2. Do you think men chat more than women? 

I think this is probably one of the most controversial and provocative questions that want s to raise the issues of gender differences. It depends on the situation again, if you’re talking about the topics that a lot of men take interest in, like technology, cars, gadgets, racing events , things like that, or airplanes, I’ve seen many online forums or podcasts where men and male audiences get involved and exchange ideas on these topics, and even the hosts are men. Whereas, with women, we tend to talk about topics that are more related to our daily lives or our feelings, so when women get together we tend to talk about what we’ve been up to, relationships, marriage, children, beauty, fashion things like that are more personal. So if you’re talking to a man about cosmetics, I don’t think they will be very talkative , but if you’re talking to a woman, they can talk at length  about it.

• Vocabulary:  racing events – horse racing, motor racing, marathons, bicycle races etc.
• Phrase: to talk at length about something – to talk for a long time, or in great detail about a topic
• Vocabulary:  talkative (adj.)  – a person who enjoys talking a lot

3. Why are social networks so popular nowadays? 

As I said before, there are many occasions where face to face communication isn’t possible so social networking sites help people stay connected with friends and family in other parts of the world. So even if they don’t live together, you can still stay up to date   with what they do through the posts they upload . Also, social media sites like Facebook, YouTube Instagram  have already created a lot more opportunities to people who really want to express themselves, so we know there is a new job title called an ‘ influencer’ or ‘YouTuber ‘, and there was no such thing as   that 10 years ago, but now they are just all over the place , they can make money and express themselves, so now it has become one of the most popular areas that young people want to go into. So I would say with social media some people feel empowered because they probably don’t get the opportunity to go on TV shows and show what they can do, but they can do through social media sites, so those are 2 reasons why social media is so popular nowadays.

• Phrase: stay up to date with  – stay updated or be aware of the latest news (friends / news / gossip)
• Phrase:  there was no such thing as + noun  – that didn’t exist before
• Preposition:  on TV

4. How can encourage shy children to talk more? 

I think from personal experience, people are more willing to talk about what they are interested in. If they have the passion for it, you don’t have to force them. First of all, as parents or as a teacher, if you just want to encourage your shy friends, you have to spend some time exploring what they are interested in and start conversations with them that are related to their interests and show that you are really curious about how much he or she knows in that field. It’s very motivating, because people can tell when you are being sincere about wanting to know what someone knows. It applies to any kind of person.

COMMUNICATION AND PERSONALITY is a common topic in IELTS. Here is a list of words that you need to know to get a good score. 1. To hide one’s light under a bushel Meaning: to conceal one’s talents and skills Example: Please don’t hide your light under a bushel—the Society needs your valuable expertise.

18. set in his or her ways Meaning: A person who is set in his or her ways is stubborn and committed to their current way of doing things. They aren’t open to changing, even if the change would be an improvement Example: As people get older, they often become set in their ways and are reluctant to try anything new.

19. a social butterfly Meaning: refers to an extroverted person who loves to socialize Example: A social butterfly is a person who is socially dynamic, networking, charismatic, and personally gregarious.

20. a stickler for sth Meaning: Someone who is a “stickler for something” is a person who strongly insists on that quality or behavior, and wants or expects other people to maintain the same standard Example: The author described himself as a stickler for details, who loves things done right the first time.

IELTS Essay, topic: The Internet and communication

• IELTS Essays - Band 7

Some say that the Internet is making the world smaller by bringing people together. To what extent do to you agree that the Internet is making it easier for people to communicate with one another?

Electronic mail, instant messages, web cameras and microphones; all these gadgets and programs make the presence of the other person more real. Who knows; with the help of visual reality you might even get a 3-D image of the speaker! I believe that the Internet is one the best inventions of the last century, you can hardly get to miss anyone and nobody is really out of reach. You can keep in touch with your friends, and be able to do your work from your bedroom in your pajamas!

However, the internet can also be a major source of harassment. Spammers and hackers can invade your privacy and get personal/confidential information, which otherwise they never get access to. You are never out of anybody’s reach, unless you make a conscious decision of not checking your email, there can be always more work waiting for you in your inbox and you might never have a moment to yourself. Worse yet, if you were a workaholic, you might never experience that stress-free vacation ever again in your life – simply, because you have your mobile workplace with you at all times.

As a romantic, I will always look forward to getting an occasional letter in the snail mail. A personal letter, where I can sense the mood of the writer by the slants in his/her handwriting and get to know him/her better. But as a type A personality person, the internet gives me all what I dream of in terms of communication – the speed, reliability, and convenience of time and place. I can certainly tolerate its shortcomings any day, as long as it keeps me close to my loved ones.

This is a great essay, which seems worthy of Band 7 or perhaps even 8. It is longer than required (340 words instead of 250) which means that it took you more time to write and less time to check your work.

Hi Sarwar, you can write your opinion in the conclusion paragraph instead of the introduction. It won’t affect your score for task response.

The most typical example of today’s communication technology is the mobile phone. Originally designed to provide people with instant access to telecommunication, it has become indispensable for most people in modern society. Nowadays, various features such as built-in cameras and interactive games have been added to the mobile phone, making it multifunctional and thus even more popular. However, I believe the omnipresence of mobile phones in particular, or digital communication tools in general, often interferes with the bonding time that people share and thus has a negative influence on interpersonal relationships. There is compelling evidence for my belief. If people use mobile phones for work purposes, business calls may disrupt any real-life conversations they have. This is the case for millions of working people who may have overlooked the importance of having smooth and uninterrupted conversations with other people. They may be unaware that relationships are at risk of eroding when people spend less quality time with each other. Also, if people use mobile phones to play games, the constant urge to complete game missions may disengage them from social gatherings. For example, many teenagers sacrifice real-life socialising time for mobile game playing time. In the long term, this would be likely to cause friends to drift apart.

There are many real examples of couples on the verge of breaking up because one or both partners have grown overly attached to social network applications on mobile phones, and they find it hard to maintain a sense of intimacy.

 Although most people use mobile phones for all personal as well as professional reasons and consequently, they need to pay constant attention to their phone, however, potentially isolating those in their company. In this way, mobile phones may dull real-life interactions and affect relationships as a result.

In brief, the constant distraction of modern communication devices such as mobile phones may cause the breakdown of numerous social relationships.

Ever since the era of technology emerged, life has changed dramatically. Today where every second thing is being operated by digital contrivances, some ill effects have come floating by, as well. Generally, people put forth that the current digital scenario and communication devices and interfaces particularly have impeded and halted conventional interactions. I agree with this notion and shall be illustrating the same in the forthcoming paragraphs.

It is an inevitable truth that digitization has made our arduous lives extremely cosy and that it nearly ineluctable tangent that we all are on today. Family gatherings, outings and various other aspects of live communication have been trampled down upon with the uprising of online social networks. One to one discussion has been displaced by social media, the family time has been subjugated by facetime and webcams. Mobile phones have been the major disruptive cause in evicting out the person to person verbal communication. Owing to this sociability and amicability has been corroded off to substantial capacity. 

Secondly, people while being there in an online medium and e-communication transmission mask their realities to a larger level where it is hard to discern as to what one person is gravely going through behind the lenses. Moreover, a sense of harmony and connectedness has been deeply lacerated as one can’t get through the emotional streamline of others as well as it is in the case of one to one conversation. In addition to that, work from home, online schooling and internet parties can never compare and become congruent to the essence of offline setup. The gist and feel of very communication without screen barriers have definitely been exacerbated by the day to day unstinted techno-growth. Due to this, the communication gaps, misconstruction, misconception and misunderstandings have been preponderant and therefore, the relations have turned rancorous. For instance, many times the people who tend to be at loggerheads, resolve and laugh out the grudges they had post figuring out how paltry the issue was that could have never had been aired had the communication was in an offline environment. 

Though online communication tools are the need of the hour, the way it has obliterated and debilitated the lines of personal communication with a tinge of conversing effectively is indisputably true as well.

Therefore, in the conclusion, it could be stated that the layer of social harmony and personal belongingness has indeed been excruciated by the pillars and towers of online networking, where people communicate only when they are extremely in need of, thereby making them recluse and secluded.

In the era of digitalisation, the huge reliance on information technology to change the world in a unique way is no longer a fresh perspective. The advent of AI adoption and vast social media interaction is partly blended into human’s daily life. As a result, it ramps up the globalisation and distance between people is getting shorter as digital technology integrates people around the globe. On the flip side, negative consequences have been imposed on deteriorating social relationship. Regarding this statement, I am on the same wavelength with the stated opinion by providing strong reasoning as below.

First, the innovation of present communication technology has established an adamant fact that it changes human lives by accelerating the socioeconomic changes. There are a lot of built-in apps and online games available for people to explore by using their sophisticated mobile phones. Nonetheless, excessive reliance on the mobile phones will aggravate the fundamental relationship-building with people in real life. According to a publication, the teenagers and young adults have spent an average of 4 hours daily on their mobile phones. The result indicates that they devote most of their leisure time on gluing to the mobile screens apart from working or studying. Moreover, most parents reveal the truth that their children enter their rooms once they are back from school. This negative and worrying phenomenon has been invading the original social life as an adult, and they are ignoring in fostering a genuine relationship with their loved ones through face-to-face conversation. In the meantime, the addictive behaviours on playing online games among teenagers inhibit their intellectual skills as this may impact how they think, interact and work when they are entering the working society.

Second, the online education and various virtual meetings have been promoted since the outbreak of the COVID-19 which restrict people from engaging in real world environment. The rise in the digital adoption has particularly provided convenience to majority of people as they have the chance to obtain learning certificates from prestigious institutions in the view of ensuring a stable internet connection during the lesson. Despite these conveniences, the virtual studying environment is simply incomparable to the physical learning condition as most of the lectures could not detect the implicit or verbal behaviours of the students to acknowledge whether they are fully comprehending their lectures. This certainly makes the learning outcome less desirable compared to conventional teaching method. For instance, I am the living example who currently pursuing an online MBA program. In fact, I have lost the real opportunities to have a post-class discussion with my classmates or lecturers as there was a time limit being imposed on the live session. In accordance with these constraints, I had to post my questions by sending e-mail and Whatsapp messages which increases the communication cost due to longer time taken for replies. This poses some barriers on me in fortifying relationship with faculty members and fellow classmates.

As whole, I am advocating strongly that unintended social consequences are eminent due to extensive use of advanced communication technology. Although online communication provides fresh alternatives to expand the choice of communication medium, this tool should not be supplanting the primary use of communication tool via physical interaction. As a fact, digital communication tool is providing supplementary outlet for the role of real-world communication when someone is not available for meet-ups.

Notice of FY 2025 H-1B Cap Initial Registration Selection Process Completion and Cap Season Reminders

H-1B Initial Electronic Registration Selection Process Completed

U.S. Citizenship and Immigration Services has received enough electronic registrations for unique beneficiaries during the initial registration period to reach the fiscal year (FY) 2025 H-1B numerical allocations (H-1B cap), including the advanced degree exemption (master’s cap). We have randomly selected enough properly submitted registrations for unique beneficiaries projected as needed to reach the H-1B cap and have notified all prospective petitioners with selected beneficiaries that they are eligible to file an H-1B cap-subject petition for such beneficiaries.

Registrants’ online accounts will now show one of the following statuses for each registration (that is, for each beneficiary registered):

• Submitted:  The registration has been submitted and is eligible for selection. If the initial selection process has been completed, this registration remains eligible, unless subsequently invalidated, for selection in any subsequent selections for the fiscal year for which it was submitted.
• Selected:  Selected to file an H-1B cap petition.
• Not Selected: Not eligible to file an H-1B cap petition based on this registration.
• Denied – duplicate registration:  Multiple registrations were submitted by or on behalf of the same registrant for the same beneficiary. If denied as a duplicate registration, all registrations submitted by or on behalf of the same registrant for this beneficiary for the fiscal year are invalid.
• Invalidated – failed payment: A registration was submitted but the payment method was declined, not reconciled, or otherwise invalid.
• Deleted: The submitted registration has been deleted and is no longer eligible for selection.
• Processing submission:  USCIS is processing your submission. It may take up to 72 hours for all of your case information to show on the case details page. While it is processing, you will be unable to access your draft.

FY 2025 H-1B Cap Petitions May Be Filed Starting April 1

H-1B cap-subject petitions for FY 2025, including those petitions eligible for the advanced degree exemption, may be filed with USCIS beginning April 1, 2024, if filed for a selected beneficiary and based on a valid registration.

Only petitioners with registrations for selected beneficiaries may file H-1B cap-subject petitions for FY 2025.

An H-1B cap-subject petition must be properly filed at the correct  filing location (see H-1B Form I-129 Filing Location Change to Lockbox section below)   or online at  my.uscis.gov and within the filing period indicated on the relevant selection notice. The period for filing the H-1B cap-subject petition will be at least 90 days. Petitioners must include a copy of the applicable selection notice with the FY 2025 H-1B cap-subject petition.

Petitioners must also submit evidence of the beneficiary’s valid passport or travel document used at the time of registration to identify the beneficiary.

Petitioners filing for selected beneficiaries based on their valid registration must still submit evidence or otherwise establish eligibility for petition approval, as registration and selection only pertains to eligibility to file the H-1B cap-subject petition.

New Fees and Form Edition

On Jan. 31, 2024, USCIS published a  final rule   that adjusts the fees required for most immigration applications and petitions. The new fees are effective April 1, 2024. Petitions postmarked on or after April 1, 2024 , must include the new fees or we will not accept them. Additionally, there will be a new 04/01/24 edition of  Form I-129, Petition for a Nonimmigrant Worker . There will be  no grace period  for filing the new version of Form I-129 because it must include the new fee calculation.

What to Know About Sending Us Your Form I-129.

• We will accept the 05/31/23 edition of this form if it is postmarked  before  April 1, 2024;
• We will not accept the 05/31/23 edition of this form if it is postmarked  on  or  after  April 1, 2024; and
• We will only accept the 04/01/24 edition of this form if it is postmarked  on  or  after  April 1, 2024.

We will use the  postmark date  of a filing to determine which form version and fees are correct but will use the  received date  for purposes of any regulatory or statutory filing deadlines.

As a reminder, we recently  announced  a  final premium processing fee rule  that increased the filing fee for  Form I-907, Request for Premium Processing Service , to adjust for inflation, effective Feb. 26, 2024. If we receive a Form I-907 postmarked on or after Feb. 26, 2024, with the incorrect filing fee, we will reject the Form I-907 and return the filing fee. For filings sent by commercial courier (such as UPS, FedEx, and DHL), the postmark date is the date on the courier receipt.

Online Filing and Organizational Accounts

On Feb. 28, 2024, we launched new online organizational accounts that allow multiple people within an organization and their legal representatives to collaborate on and prepare H-1B registrations, H-1B petitions, and any associated Form I-907. Information on organizational accounts is available on the  Organizational Accounts Frequently Asked Questions page.

We also launched online filing of Form I-129 and associated Form I-907 for non-cap H-1B petitions on March 25. On April 1, we will begin accepting online filing for H-1B cap petitions and associated Forms I-907 for petitioners whose registrations have been selected.

Petitioners will continue to have the option of filing a paper Form I-129 H-1B petition and any associated Form I-907 if they prefer. However, during the initial launch of organizational accounts, users will not be able to link paper-filed Forms I-129 and I-907 to their online accounts.

H-1B Form I-129 Filing Location Change to Lockbox

Starting April 1, 2024, H-1B and H-1B1 (HSC) Form I-129 petitions are no longer filed directly with the USCIS service centers. All paper-based H-1B and H-1B1 (HSC) Form I-129 petitions are now filed at USCIS lockbox locations. This includes cap, non-cap, and cap-exempt H-1B filings.

We will reject H-1B or H-1B1 (HSC) petitions received at a USCIS service center on or after April 1, 2024. There will be  no grace period  provided.

USCIS has specific mailing addresses for cases that are subject to the H-1B cap. To determine the correct mailing address, please see our  Form I-129 Direct Filing Addresses  page.

If a petition is filed at the wrong location, we may reject the petition. Rejected petitions will not retain a filing date. If we reject a petition because it was filed at the wrong location, it may be refiled at the correct location, or online. H-1B cap subject petitions may be refiled at the correct location, or online, as long as the petition is refiled during the designated 90-day filing window listed on the selection notice.

No More Pre-paid Mailers

As of March 25, 2024, we are no longer using prepaid mailers to send out any communication or final notices for any H-1B or H-1B1 (HSC) petitions. With H-1B intake now occurring at the lockbox or online, we will not be able to use any prepaid mailers for H-1B or H-1B1 (HSC) filings.

The process of printing and mailing H-1B petition approval notices by first-class mail is fully automated. For petitions filed online, myUSCIS account holders will also receive an email or text message notification in their myUSCIS account when there is a case status change on a case in their account, followed by a paper notice by mail.

Receipt Notice Delays

When we receive a timely and properly filed H-1B cap subject petition, the petitioner (and, if applicable, the petitioner’s legal representative) will be provided a Form I-797, Notice of Action, communicating receipt of the petition. Due to increased filing volumes typically seen during H-1B cap filing periods, there are instances where a paper petition is timely and properly filed by mail, but issuance of the Form I-797 is delayed. If you are a petitioner and have confirmation from the delivery service that the petition was delivered, but you have not yet received a Form I-797 confirming receipt of the petition, you should not submit a second petition. If you have confirmation from the delivery service that the petition was delivered and you then submit a second H-1B cap petition for the same beneficiary, you will be considered to have submitted multiple H-1B cap petitions. This will result in denial or revocation of both petitions.

If more than 30 days have passed since the confirmation of delivery and you have still not received a Form I-797, you may contact the  USCIS Contact Center  for assistance.

If you receive notification from the delivery service, or your tracking information suggests that there may be a delay or damage to the package or that the package was misrouted, you should follow the Delivery Service Error Guidance on the  H-1B Cap Season  webpage.

California law would give employees the 'right to disconnect' during nonworking hours

Anyone tired of answering emails and calls from their boss after work may soon be protected by law in California.

A bill has been introduced in California legislature that would give employees the "right to disconnect" from their jobs during nonworking hours.

Assemblymember Matt Haney of San Francisco first introduced the bill, Assembly Bill 2751 in February, which would allow employees to disconnect from communications from their employer during nonworking hours.

If passed, California would be the first state to create a "right to disconnect" for employees. Similar laws have already been enacted in 13 countries , including Australia, Argentina, Belgium, France, Italy, Mexico, Portugal and Spain.

'Right to disconnect' law would help define nonworking hours

If the bill were to become law, it would define the "right to disconnect" as the right for employees to ignore communications during nonworking hours "except for an emergency or for scheduling, as defined." Both public and private employers would be required to create a workplace policy that allows employees the right to disconnect.

It would also require nonworking hours to be established by a written agreement, and would allow employees to file a complaint of a pattern of violation with the California Labor Commissioner, which would be punishable by a fine.

Haney's "right to disconnect" bill has not yet been passed or signed into law, but has been referred to the Assembly Labor Committee to be heard.

As of Monday, most of the fast food workers in California will be paid at least $20 an hour, up from the state's previous $16 an hour. The bill, which was signed by California Gov. Gavin Newsom in September, also establishes a fast food council that will develop standards, rules and regulations for the fast food industry.
