Indian Judicial Service Examination or the Provincial Civil Service Judicial Examination (PCS-J) is an entry level exam for law graduates. It is not mandatory for law graduates to appear in All India Bar examination to appear for Judicial Services Examination. Through this civil judge exam law graduates can become district magistrates, additional district magistrates, or as a district court judge in India.

The members are appointed by the state governments under the supervision of the respective high court, based on Judicial Services Examinations. Every High Court has under its supervision the members of the subordinate judiciary of the state that falls under its jurisdiction. Members of the subordinate judiciary (popularly known as the judicial service or the PCS (J)-Provincial Civil Service-Judicial) occupy the offices of the presiding officers of various courts right up to the post of District Judge.

State Judicial Service exams in India are conducted by each state differently. In total, 24 states in India conduct Judicial Service examinations nearly every year. These are as mentioned below.

Each of these states has its eligibility criteria for the judiciary exam in the form of age limit, number of attempts, and official language, and others.

Judicial Exam Eligibility

The All India Judicial Service exam eligibility criteria are different for lower judiciary and higher judiciary services.

Lower Judiciary Services –

The Judicial Services Examination eligibility criteria is given below :

Candidates must be citizens of India

Candidate must have a degree in either 3-year LLB or 5-year LLB

He/she should be enrolled or qualified to be enrolled as an Advocate under the Advocates’ Act 1961.

Final year candidates can also give the exam and no experience is required for the exam.. The age limit is usually between 21 to 35 years. However, it varies according to the state. In some states the upper age limit is 40+ years.

Higher Judiciary Services – Candidates must be law graduates. In addition to that, the judiciary exam eligibility for higher judiciary also requires certain minimum number of years of litigating practice, usually seven years.

The judiciary exam is conducted rather unexpectedly. So, candidates must keep track of the upcoming judiciary exam 2024. All the states release their application forms separately.

The prelims exam for Judicial services are conducted after one month from the date of opening of the application form.

For some states, the application form of Judicial Services Examinations are released on the official website of the state High Court. For example, the High Court of Haryana notifies about the judicial service examination on its official website - highcourtchd.gov.in.

Whereas, there are states releasing their application form in their respective Public Commission State website, for example: In the state of Maharashtra the application form of Judicial services examinations are released by the state Public Service Commission in its website - mpsc.gov.in.

After filling up the application form, aspirants are required to pay a prescribed fee that varies for the general and reserved categories.

Aspirants willing to serve as a civil judge/district magistrate/additional district magistrates need to clear three of the exams. These stages are:

Judicial Services Examination - Preliminary

The exam comprises objective type questions. It only serves the purpose of screening candidates before they appear for mains. The marks secured by a candidate in this section are not considered for the final selection.

At the second stage of Judicial Services Examination, the mains exams are conducted. The Judicial Services Exams for Mains are generally conducted after 20 to 40 days after the declaration of prelims results. This is the reason why the aspirants start preparing for judicial service examinations during their college days.

The Judicial Services Mains exams are subjective in nature, and mainly comprise three to four papers. The marks scored in mains are considered for the final selection.

This is the final stage of the selection procedure. At this stage, candidates are assessed based on their general interest, intelligence, personality, etc

Aspirants after clearing all the stages and then qualifying for the merit list will be able to join the respective state’s judicial academy for a year to be trained as a Judge.

Successful candidates will be taught about the legal or judicial procedures, manners of being a judge as well as the duties and power the position carries.

After successful completion of training the candidates will be appointed as judges of lower courts or tribunals.

The syllabus for judiciary exams differs from state to state. The procedural law and substantive laws are similar for all the states, however the local language and local laws differ from state to state. The prelims syllabus for Judicial Services Examination is broadly divided into Civil law, Criminal Law and Language paper. The weightage of the language paper is around 20 per cent to 35 per cent. The mains examination consists of six to seven papers and almost 70 per cent of the questions are asked from law.

Restriction of age

In some states the upper age limit to fill the application forms are 32 whereas in some it can be 48 years. So candidates should carefully consider the age restriction before filling the application form.

Restriction in the number of attempts

In some states the number of attempts are 6 whereas in some it is 4. So candidates should carefully assess the number of attempts before appearing for the examination.

Syllabus of almost all state judiciary exams are similar in terms of content. A candidate's prior comfort with laws and legal concepts will make the exam easy for them. The difficulty will also depend on the number of seats on offer versus the competition level.

Before applying for the law certification exam, candidates should review the AIBE XVII (17) 2022 eligibility criteria.

Candidates applying for AIBE XVII (17) must have completed a 3-year or 5-year LLB program from a BCI-accredited institute.

Candidates must have completed their degree program after July 1, 2012.

Candidates applying for the AIBE XVII (17) 2022 exam must be members of their respective State Bar Councils and hold an Advocate Card.

There are no minimum marks or age requirements to take the AIBE XVII (17) examination.

Candidates must pass the AIBE examination within two years of completing their graduation. If a candidate is unable to pass the examination within two years of graduation, he or she must re-register/enroll with the state bar council in order to take the AIBE examination.

You only need to register once with the state bar council in order to appear for the AIBE exam. The Bar Council of India has clarified that the validity of two years is applicable only for the practise of law.

So, if you have to practise law, you must clear the AIBE exam within two years of registration and obtain the Certificate of Practice . However, you can appear for AIBE any number of times, even beyond two years after registering once. If you clear the AIBE examination after expiry of two years of registration with the state bar council, then you have to register again with the bar council to be able to practise law.

The AIBE admit card is released through the official website of AIBE. Sometimes due to technical issues students face difficulty in downloading their admit cards. Students are advised to try downloading their admit card of All India Bar Examination after sometime. Judiciary Mains Examination: The Art of Answer Writing

Hello Aspirants! Welcome back to the Lawctopus Judiciary Corner series .

This article will discuss one of the most crucial questions from the judicial examination point of view. The question is- How should I write my answer?

To some, it may appear as an irrelevant question. Why? Because during the five or three years we spend in law school, we involve ourselves only in research papers, moots, and tons of examinations. We firmly believe that we know everything related to answer writing. Right? Well, not really. Let me tell you why.

Bursting the Bubble of Mains Answer Writing

Believe it or not, law schools do not prepare us for various competitive examinations. People who get selected in Judicial Services avoid writing their answers as a typical law student. Instead, their answers reflect their thought process, knowledge of the law, and its applicability.

Successful aspirants frame the answers in a manner that reflects clarity of legal concepts, filter out relevant information with convincing reasoning to the examiner. So, comparing the answer written by a law student with a judicial aspirant would be like comparing apples to oranges.

But no worries. Every aspirant who ever made it to the merit list and joined Judicial Services started from scratch. You can, too, learn to write your answers just like a successful judicial aspirant.

But truth to be told, it is not a piece of cake. One has to practice consistently for at least 3-6 months. If you are ready to do that, then continue reading to find out how.

The method discussed below for answer writing applies to everyone regardless of the State Judicial Service Examination you are attempting. So be it Delhi Judicial Services (DJS) or Haryana Judicial Examination, it works for everyone.

Mains Answer Writing: Crisp, Precise, and Desirable

Answer writing is an art that you need to master for clearing the Mains examination.

But how do you do that?

The perfect answer has three main essential ingredients. Crisp, Precise, and Desirable. Your answer needs to have these three components as per the question.

You may ask why? It’s simple. Because you start with limited time on your hand when you sit for the exam. You get only three hours to attempt the paper & not following these three components may make you miss two or three questions that can cost you an entire year.

The judicial examination is a race against time & one mistake can make you start again from the beginning. By remembering the Crisp, Precise, and Desirable rule, you will be able to finish your paper on time & your answer will reflect your preparation and preciseness that is very important.

Beating around the bush or mentioning irrelevant information will go against you. Aspirants need to forget the law school method of answer writing. Learn and practice writing only information that is relevant to the topic.

You will be able to incorporate these rules only if you practice answer writing daily. Stop assuming that it will come naturally to you when you sit for the exam. Remember, many times students blank out due to the lack of preparation and practice.

Pattern of Mains Answer Writing

Students don’t face problems when they attempt conceptual and direct questions. However, when it comes to hypothetical questions, they do get nervous. Especially in the Delhi Judicial Service Examination, it is the trend that most questions are hypothetical.

So what should be your strategy to tackle such questions? You can follow the advice of Yashdeep Chahal AIR 1 Delhi Judicial Service Exam, 2019.

He suggests, for answer writing, practice is the key & there is no alternative to it. The answers need to be in a structured manner. For writing answers, candidates need to adopt an analytical approach.

The analytical approach consists of the following stages:

Find out what exactly is asked in the question.
Determine the length of the question by marking points. Don’t write 20 marks worth of content in a 5 marker question.
Don’t start writing answers immediately. Take a moment, make a mental plan of the chronology of the answer, and then write.
Follow a uniform pattern for all answers. Don’t go around spending much time and effort on one answer and finish the others casually.
Prepare answers beforehand. For example, if you are studying a specific topic, let’s say Confession, then prepare five marks, ten marks, and twenty marks answers in advance.

Also, try linking your answer with the Constitution whenever possible. Because the Indian Constitution is the pillar for all the laws, it would make a difference.

Practice for Mains Answer Writing

Learning, Repetition, and Consistency is the key to success in any examination. You need to realize that your paper is going to be very long so you need to manage your time well. Revise everything you studied during the day.

You can try to filter your syllabus into three areas:

Very important
Not so important

With this method try to make specific notes of important topics and revise them weekly, if possible. It helps you write the answer as you won’t waste time thinking about how to go about it. As you need to impress the examiner with your answer in a limited time, so it is better to prepare your synopsis in advance.

Because they do the small but important things differently than others. How to Write the Best Answer in Judiciary Mains Exam

State Judicial Examination, popularly known as PCS(J) , or Judiciary Exam, consists of three stages. They are Preliminary , Mains , and Interview . One needs to clear all these stages to become a judicial officer.

Preliminary is the qualifying stage. After that, based on the assessment in the Mains exam, students are selected for the interview. In most cases, it is the Mains exam that decides whether a student is capable of making it through or not.

There are several tips and techniques to write the perfect answer in the Judiciary Mains exam. An on-point answer makes our paper stand out and impressive. Let us look at twelve effective ways to write the best possible answer in the Mains exams for the year 2024 and beyond.

Tips to Write the Best Answer in the Judiciary Mains Exam

While writing the Mains paper, many things need to be kept in mind. The race is not easy, but not very difficult either. A systematic approach can make it work.

Important points to write the best answer while sitting in the hall for the Mains exam are as follows.

1. Make Sure You Understand the Question.

The first thing that we see in the paper is the arrangement of questions as per the allocation of marks. Before flipping on any other item, you must understand what the question is asking.

For example, If the question is why the evidence of an accomplice is not trustworthy? Then, you cannot write what evidence is and who is an accomplice. This will lengthen your answer, and you won’t be able to write the main content asked in the question.

Sure, if it is a detailed, long answer question, then go for it. But if the question carries fewer marks, stick to the point. Do not write stories. This is not your college or university exam. Here, the more precise and on-point you are, the better are the chances for scoring well.

2. Stick to the Word Limit.

The word limit is mentioned for every question or set of questions. It is there for a reason. So, keep the answer within the word limit. Examiners value and appreciate the answers written within the prescribed limit.

The team that sets these high-level papers roughly knows in how many words the answer to a particular problem can be described masterfully. So, value the limit set by them. If you exceed the word limit, it may backfire.

What is the use of holding your nose by bending your hand around your neck when you could have simply held it from the front?

3. Keep Your Answers Simple.

Try to write your answer in the most straightforward form. Your motto should be to convey your ideas in a way that a wide range of people can understand. Inserting big and tough words does not necessarily make your answer attractive.

However, in the Judiciary Exam, do not restrict yourself from using legal maxims and phrases to support your answer. These words make the writing presentation quite impressive.

4. Write Short Sentences.

In the Judiciary exam, your primary motive should be to make yourself heard. The best way to clearly express yourself is to write short sentences. They are easy to read, understand, and convey the impression of friendliness. You may also choose to write in points. Like (1), (2), (3), and so on.

When you prepare for PCSJ exams, practice writing small sentences in your notebook. If you write a lengthy sentence, practice the art of breaking it into two or three separate smaller pieces. This will gradually become your habit.

Note : When you are writing the exact law, then do not break it. In that case, you have to write the long sentence or, however, the section name is (which may be devoid of regular grammar and norms. Law sentences are quite lengthy.)

5. Break the Answer into Paragraphs.

A long paragraph is arduous to read. Short paragraphs, on the other hand, are easy to consume. Also, dividing your long answer makes the presentation better.

Now, you may ask, what is the ideal paragraph size? Well, it varies. However, the acceptable limit ranges from three to five sentences. These small chunks of precise writing in short sentences are valuable for all written exams or projects you undertake in the future.

6. Make Ample Use of Legal Terms.

While writing, try to make the answers precise by using legal terms and words. For example, Suppose you are trying to say that the marriage is void and parties have no legal obligations attached to it. This sentence is perfect, and it makes sense, as well. But since you are writing a law exam, try to use legal terms.

Here, you can simply write that the marriage is annulled. It sounds short and on point and exhibits that you have read multiple law content. The examiner will be impressed.

7. Mention Important Case Laws.

Adding case laws to the answer makes it more authentic and convincing. The latest case laws work as a punch mark to the written law that you write in the answer.

Even if you don’t remember the name or citation of a case, you can only write the verdict. The examiner is not very interested in knowing the name or story behind a case. Instead, he wants you to mention the verdict or the judgment delivered by the apex court. Make sure you write this appropriately and suitably.

8. Follow Proper Judgement Writing Format.

When you are attempting to write a judgement in your answer, remember the format or the sequence. It is simple, and you can find these in various law books . The main thing in writing judgement is inferencing the correct law and its application to the given facts.

9. Avoid Using Many Abbreviations.

You are sitting in the hall, hoping to become a member of the judicial services. Show this in the paper as well. Filling your subjective answers with abbreviations makes it less formal.

You are not using a small smartphone display or exchanging fun conversations with your mates. Rigorous hard work of multiple years should reflect in your words. Do not ruin it with a quick abbreviation.

When a person reads a paragraph, he wishes to continue a flow while reading all the sentences. A short form or punctured word breaks this flow. Make the paper checker comfortable with your answers. Always remember you are an upcoming judge. Your words should reflect your mindset and philosophy.

10. Have a Synopsis in Mind.

Before putting the pen on the sheet, make sure to have an outline in mind. Ensure that you have a clear picture of the layout of your answer. Do not think that ‘ I will improvise as I proceed. ‘ Have a clear picture from the beginning. It prevents mistakes and makes your answer more systematic and chronological.

11. Set an Estimated Time Limit for a Question.

You know your writing speed and the duration in which you can put thought from mind to paper. So, how much time to give to a question or set of questions (short or long) entirely depends on you.

When writing an answer, try to complete it within your set time frame. If you stretch one or two questions and exceed the time limit, you will unnecessarily start to panic and lose control. So avoid that. The above tips, like sticking to the word count and having a summary before writing, will significantly help in adhering to the time limit.

Always remember that one or two questions with good, long answers are not an excuse to miss even a single question!

For example , Suppose there are two long answers, and 40 minutes remain. You utilise 32 minutes to write an excellent answer to one question and have only 8 minutes for the second one. Don’t do that.

In 20 minutes, you can write an answer that will award you 7 out of 10 marks. If you utilise 32 minutes, most likely, you will get 8.5 out of 10 for that.

Just think that, for 1.5 additional marks, is it okay to sacrifice the other question where you could have easily scored a minimum of 5 or 6 marks had you given it the appropriate share of the remaining time?

12. Allot the Last 15 Minutes for Revision.

This is a very crucial time. Within fifteen minutes, you have to go through the whole paper, which took you multiple hours to write! But it is essential.

In these fifteen minutes, check if you have missed a word, an essential note, punctuation, a short example, or a case name. You may also use this time to underline the crucial points of an answer. This time is also suitable to check your credentials once more and ensure that everything is correct.

Keeping these techniques in mind, you can attempt the Mains examination efficiently and flawlessly. A systematic approach can make any horse win the race. Pick your weak points and work on them. Appropriately utilise the time now. Back it up with a proper routine and proper management . Once you discipline yourself, no goal is too big.

What Stephen Breyer gets wrong about the Supreme Court’s ‘civility’

The public’s trust in the Supreme Court has plummeted , as the conservative supermajority decisions have already stripped Americans of rights and threaten more of the same. But in a new essay published Wednesday in The New York Times , former Supreme Court Justice Stephen Breyer suggests a more pressing concern for the high court and the country: Are the justices friends?

For all Breyer’s anecdotes, the core of his essay is still emphasizing the humanity of justices who are more than willing to de-emphasize the humanity of others in their decisions.

Breyer suggests that differences of opinion between the justices, “important as they are,” must “remain professional, not personal.” This was the case while he was a justice, he writes, and “this meant that we could listen to one another, which increased the chances of agreement or compromise.” Such congeniality is a template for a divided nation, Breyer argues — without going into detail about the actual disagreements between the left and the right on matters like race, gun safety and voting rights.

The retired justice’s piece is filled with anecdotes about the various justices he served alongside ribbing each other and finding connection despite their policy differences. It would all be charming — if it weren’t for the obscene amounts of power those nine justices wield, no matter how chummily they do it. Instead, the sentiment of Breyer’s writing manages to combine that of a disgruntled retiree’s sepia-tinged remembrances and an overly earnest Facebook post. For all Breyer’s anecdotes, the core of his essay is still emphasizing the humanity of justices who are more than willing to de-emphasize the humanity of others in their decisions.

In a sense, this is nothing new for the former justice. It hearkens back to his former traveling debate with the late Justice Antonin Scalia, a lion of the conservative originalist movement in the courts. It was their way of demonstrating that strenuous debate over the law doesn’t equate to being enemies who use political calculations in their rulings. “Judges make terrible politicians,” Breyer told a Senate hearing back in 2011 alongside Scalia, arguing that there was little room for making political calculations in their rulings. “We have to make decisions based on reason. That’s it.”

It’s a sentiment that was worthy of a side-eye even at the time, and has only gotten less convincing as the court’s composition has shifted away from the center. Placing civility and agreeability over differing views is a hallmark of the centrist line of thought, using the appearance of goodwill to disguise the depth of division between two positions. Politics is the art of being able to determine the law, and the law is the codified result of a society’s politics. That is never more the case than when decisions of vast importance before the Supreme Court are decided based almost entirely on the political considerations of the justices in the majority.

The gulf between Breyer’s hopes and reality was on display in the momentous 2022 decision to overturn Roe v. Wade’s abortion protections.

In a Times article from this past December on the behind-the-scenes maneuvering ahead of that opinion, Breyer is described as someone who “was sometimes dismissed by other liberals as an overly optimistic institutionalist who underestimated the ambitions of the conservative majority.” It emphasized though his “strong ties with justices on the right” that he hoped could be used to find some kind of consensus on the Dobbs case.

He was deeply mistaken. Unlike the Casey decision in 1992 , there was no consensus that could be forged when the end goal — striking down Roe — was predetermined before the court had heard a single word of the oral arguments. It didn’t matter how many hockey games they’d attended together, or rounds of golf had been played among them. The callous disregard from the majority for the people its decisions affect makes it hard for Chief Justice John Roberts’ complaints about criticisms of the court to find much traction. It’s also why the recent joint appearances of Justices Amy Coney Barrett and Sonia Sotomayor to promote civil debate in the face of polarization, which Breyer’s essay praised, are sure to do little to instill greater trust in the court’s decisions.

The most generous explanation is that Breyer’s intended audience isn’t the average reader of The New York Times, but his former colleagues still serving on the bench. Even if that’s the case, I’m skeptical that reminding them of the good times they’ve shared will do much to affect the actual decisions that are made. If those pleasant memories couldn’t sway his conservative colleagues when Breyer was actually voting on opinions, there’s little reason for them to listen to him now.

Mental health care is hard to find, especially for people with Medicare or Medicaid

With rates of suicide and opioid deaths rising in the past decade and children's mental health declared a national emergency , the United States faces an unprecedented mental health crisis. But access to mental health care for a significant portion of Americans — including some of the most vulnerable populations — is extremely limited, according to a new government report released Wednesday.

The report, from the Department of Health and Human Services' Office of Inspector General, finds that Medicare and Medicaid have a dire shortage of mental health care providers.

The report looked at 20 counties with people on Medicaid, traditional Medicare and Medicare Advantage plans, which together serve more than 130 million enrollees — more than 40% of the U.S. population, says Meridith Seife , the deputy regional inspector general and the lead author of the report.

Medicaid serves people on low incomes, and Medicare is mainly for people 65 years or older and those who are younger with chronic disabilities.

The report found fewer than five active mental health care providers for every 1,000 enrollees. On average, Medicare Advantage has 4.7 providers per 1,000 enrollees, whereas traditional Medicare has 2.9 providers and Medicaid has 3.1 providers for the same number of enrollees. Some counties fare even worse, with not even a single provider for every 1,000 enrollees.

"When you have so few providers available to see this many enrollees, patients start running into significant problems finding care," says Seife.

The findings are especially troubling given the level of need for mental health care in this population, she says.

"On Medicare, you have 1 in 4 Medicare enrollees who are living with a mental illness," she says. "Yet less than half of those people are receiving treatment."

Among people on Medicaid, 1 in 3 have a mental illness, and 1 in 5 have a substance use disorder. "So the need is tremendous."

The results are "scary" but "not very surprising," says Deborah Steinberg , senior health policy attorney at the nonprofit Legal Action Center. "We know that people in Medicare and Medicaid are often underserved populations, and this is especially true for mental health and substance use disorder care."

Among those individuals able to find and connect with a provider, many see their provider several times a year, according to the report. And many have to drive a long way for their appointments.

"We have roughly 1 in 4 patients that had to travel more than an hour to their appointments, and 1 in 10 had to travel more than an hour and a half each way," notes Seife. Some patients traveled two hours each way for mental health care, she says.

Mental illnesses and substance use disorders are chronic conditions that people need ongoing care for, says Steinberg. "And when they have to travel an hour, more than an hour, for an appointment throughout the year, that becomes unreasonable. It becomes untenable."

"We know that behavioral health workforce shortages are widespread," says Heather Saunders , a senior research manager on the Medicaid team at KFF, the health policy research organization. "This is across all payers, all populations, with about half of the U.S. population living in a workforce shortage."

But as the report found, that's not the whole story for Medicare and Medicaid. Only about a third of mental health care providers in the counties studied see Medicare and Medicaid patients. That means a majority of the workforce doesn't participate in these programs.

This has been well documented in Medicaid, notes Saunders. "Only a fraction" of providers in provider directories see Medicaid patients, she says. "And when they do see Medicaid patients, they often only see a few."

Lower reimbursement rates and a high administrative burden prevent more providers from participating in Medicaid and Medicare, the report notes.

"In the Medicare program, they set a physician fee rate," explains Steinberg. "Then for certain providers, which includes clinical social workers, mental health counselors and marriage and family therapists, they get reimbursed at 75% of that rate."

Medicaid reimbursements for psychiatric services are even lower when compared with Medicare , says Ellen Weber , senior vice president for health initiatives at the Legal Action Center.

"They're baking in those discriminatory standards when they are setting those rates," says Steinberg.

The new report recommends that the Centers for Medicare & Medicaid Services (CMS) take steps to increase payments to providers and lower administrative requirements. In a statement, CMS said it has responded to those recommendations within the report.

According to research by Saunders and her colleagues at KFF, many states have already started to take action on these fronts to improve participation in Medicaid.

Several have upped their payments to mental health providers. "But the scale of those increases ranged widely across states," says Saunders, "with some states limiting the increase to one provider type or one type of service, but other states having rate increases that were more across the board."

Some states have also tried to simplify and streamline paperwork, she adds. "Making it less complex, making it easier to understand," says Saunders.

But it's too soon to know whether those efforts have made a significant impact on improving access to providers.

CMS has also taken steps to address provider shortages, says Steinberg.

"CMS has tried to increase some of the reimbursement rates without actually fixing that structural problem," says Steinberg. "Trying to add a little bit here and there, but it's not enough, especially when they're only adding a percent to the total rate. It's a really small increase."

The agency has also started covering treatments and providers it didn't use to cover before.

"In 2020, Medicare started covering opioid treatment programs, which is where a lot of folks can go to get medications for their substance use disorder," says Steinberg.

And starting this year, Medicare also covers "mental health counselors, which includes addiction counselors, as well as marriage and family therapists," she adds.

While noteworthy and important, a lot more needs to be done, says Steinberg. "For example, in the substance use disorder space, a lot of addiction counselors do not have a master's degree. And that's one of their requirements to be a counselor in the Medicare program right now."

Removing those stringent requirements and adding other kinds of providers, like peer support specialists, is key to improving access. And the cost of not accessing care is high, she adds.

"Over the past two decades, [in] the older adult population, the number of overdose deaths has increased fourfold — quadrupled," says Steinberg. "So this is affecting people. It is causing deaths. It is causing people to go to the hospital. It increases [health care] costs."

Moscow, the city for life – Russia

Recently the Moscow Government published under the headline “Moscow, the city for life” its seven development priorities. A document distributed at the Moscow Urban Forum in December 2013.

Moscow is with a population of over 12 million people one of the biggest metropolis in the world. The real number of citizens is difficult to establish as Moscow is the destination of many migrants, legal and otherwise, drawn by higher salaries and better services and living conditions. In 2010 alone, 126,000 newcomers were officially registered in the city, but the actual number is certainly much higher. The Moscow International Internet Portal indicates that “By some estimates together with commuters working and studying in Moscow, migrants, transit visitors and tourists the daily actual population of Moscow amounts in general to 15 – 20 million people”. It is forecast that by 2035 the population of the Moscow region will increase by 4,000,000 people and amount to 22,800,000 people. It is expected that by 2020 passenger traffic generated by the ‘New Moscow’ will double whereas the capacity of the existing infrastructure is already exhausted.

After adopting in 2011 different government programs for the key directions of the capital’s development, the Moscow Government worked out in 2013 its main objectives for the creation of comfortable living conditions with the definition of seven development priorities: 1) Mobile City; 2) Comfortable urban environment; 3) Healthy city; 4) Well-educated city; 5) Socially protected city; 6) New economics of Moscow; 7) Open Moscow.

It is a large and ambitious programme highlighting the goals reached and progress made in the last years, and illustrating the objectives for the next years in numbers and graphics.

Moscow development priorities, Mobile City

An important part takes the improvement and development of the transport infrastructure. Moscow is literally suffocated by the significant growth of the personal car fleet, doubling from 2.6 millions cars in 2000 to 4.5 million in 2012 and the increase of commuting du amongst others to the ongoing separation of business centres and residential areas. Over two-thirds of the municipal investments have been assigned in future for the improvement and modernisation of the transport infrastructure, roads and public transport, an estimated 329 billion roubles for 2013.

Today over 60% of the total volume of Moscow passenger transportation is carried by the subway and this traffic capacity should increase by 1.2 billions persons annually. Just to illustrate the ambitions, the program foresees to rise the average annual construction of subway stations from 2.75 stations, from 2009 – 2012, up to 9.1 stations per year for the period 2013-2020, with the final objective to construct 73 new stations by 2020. They say themselves, that it is the most rapid construction program in the entire history of the Moscow subway. In comparison the metro line of the Paris metropolis, Le Grand Paris Express, foresees to build 205 km of metro lines and 72 new stations between 2013 and 2030. It seems that Moscow want to do in less than half the time.

The development priorities draw the picture of a metropolis with a population using in the last years more intensely the public spaces, the cultural institutions, the shopping area and demanding for a higher urban living standard. A population that has better access to medical facilities and a growing life expectancy, 75.8 years in 2012, and a growing natality rate. A population with opportunities for a better education starting from more kindergartens over preschools to high schools. Interesting is the development of the average salary of a school teacher in Moscow, from 39200 roubles in 2010 up to 64100 roubles in 2013: an average annual growth of 12% in a context of an inflation of approximately 6 %, leaving a real salary growth of 6 % per year. Not bad, seen from a Western European perspective.

But Moscow also wants to be a city that cares about its less fortunate citizens. The program is about social protection of older generations, assistance to needy families and persons with limited capabilities. It is about free access to public services, like transport, medical treatment, recreation, financial support and accessibility of public buildings. It also concerns providing housing for certain categories of citizens, probably one of the most difficult task, as Moscow has been ranked regularly among the five most expensive cities in the world in terms of the cost of housing.

To finance this new and improved public facilities and services, the Moscow Government counts on the dynamic of investments, supposed to grow from 732 billion roubles in 2010 up to 1719 in 2016. A mixture of better services for the investors, improved infrastructures and tax incentives should keep the dynamic going.

The Open Moscow development priority aims to create and strengthen the links between to residents and the public services. Improvements in the information and communication with the citizens, in the collecting and carrying out of suggestions of the citizens, and monitoring the activities of the public officers of municipal services, probably to fight corruption and try to establish a kind of confidence. Different internet sites like the Our City Website , regrouped in one Open Data Portal , should play in mayor part in this new Open Moscow development.

This program looks like a step in the right direction. It is developing Moscow towards a multi-layer, multi-functional city, trying to diversify the transport system, the municipal offer in public spaces, recreation and medial facilities, and supporting the poorer populations. The success of the renewal and transformation of the Gorky Park is a sign of these multi-functional and high-quality public spaces and the demand of the citizens for such spaces.

What is still missing for me is a clearer image of what Moscow wants to be in its whole, and in its parts. For the moment the document is set up as a catalogue of good intended programs, but not yet as an integral city development program. An example is the important investments in the public transport and in the road system, with the hope to encourage the citizens to abandon their excessive use of personal transport. But as long as the Moscow develops its road and parking system, citizens might prefer their car to public transport. Further detailed choices have to be taken on the different aspects of these programs and their feasibility in the near future.
